634 N.W.2d 359
No. 118467.Supreme Court of Michigan.
September 18, 2001.
COA: 219955, Saginaw CC: 97-017374-CK
On order of the Court, the delayed application for leave to appeal from the December 26, 2000 decision of the Court of Appeals is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND the case to the Court of Appeals for consideration of plaintiff’s issue concerning the intentional and criminal act exclusions of the policy, which was raised by plaintiff in its Court of Appeals brief but not addressed by that court. The delayed application for leave to appeal is otherwise DENIED, because we are not persuaded that the question presented should be reviewed by this Court.
Kelly, J., would deny leave to appeal.
