By order of December 30, 1998, the application for leave to appeal from the March 7, 1997, decision of the Court of Appeals was held in abeyance pending the decision in Brown v. Dep’t of Transportation (OnRehearing) (Docket No. 106359). Brown v. Dep’t of Transportation (OnRehearing) was dismissed by stipulation of the parties.
On order of the Court, the application is again considered, and it is GRANTED. We further ORDER that this case be argued and submitted to the Court together with the case of Nawrocki v. Macomb County RoadCommission (Docket No. 107903), at such future session of the Court as both cases are ready for submission.
