By order of May 28, 1998, the application for leave to appeal was held in abeyance pending the decisions in Suttles
v. Department of Transportation (Docket No. 106119) andBrown v. Department of Transportation (Docket No. 106359). On order of the Court, the decision having been issued in Suttles v. Department ofTransportation, supra, on June 9, 1998, 457 Mich. 635
(1998), and the appeal in Brown v. Departmentof Transportation (On Rehearing), supra, having been dismissed by stipulation of the parties in an order issued on March 3, 1999, the application is again considered, and it is GRANTED.
We further ORDER that this case be argued and submitted to the Court together with the case of Evens v.Shiawassee County Road Commission (Docket No. 109921), at such future session of the Court as both cases are ready for submission.
