On order of the Court, the application for leave to appeal from the April 20, 2001 decision of the Court of Appeals is considered, and pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the judgments of the Court of Appeals and Kalamazoo Circuit Court and REMAND the case to the Kalamazoo Circuit Court for further proceedings in accordance with this order. On remand, the court shall resubmit the matter to the same team of case evaluators, which shall issue a new evaluation clarifying the ambiguity of the former evaluation, and the parties shall accept or reject that evaluation under MCR 2.403(L).
We do not retain jurisdiction.
