622 N.W.2d 64

PEOPLE OF THE STATE OF MICHIGAN, Plaintiff-Appellee, v. DALE LEE CAIN, Defendant-Appellant.

No. 116045 (19).Supreme Court of Michigan.
December 12, 2000.

COA: 216623, Saginaw CC: 97-014769-FH

By order of June 26, 2000, the delayed application for leave to appeal was held in abeyance pending the decision in People v Bulger (Docket No. 112694). On order of the Court, the decision having been issued on July 18, 2000, 462 Mich. 495 (2000), the delayed application is again considered, and it is DENIED, because we are not persuaded that the question presented should be reviewed by this Court. The motion for bond pending appeal is also DENIED as moot.

Cavanagh, J., would grant leave to appeal to reconsider this Court’s strained reasoning in People v Bulger and save this defendant a trip to federal court for relief.
