No. 123512.Supreme Court of Michigan.
July 28, 2003.
Summary Disposition.
No. 123512. In lieu of granting leave to appeal, the case is remanded to the Oakland Circuit Court for a determination whether defendant’s sentences should be corrected to reflect the proper credit for time served. MCR 7.302(G)(1). Defendant is entitled to credit for all time served in custody as a condition of probation. People v. Sturdivant, 412 Mich 92 (1981). It is unclear from the record whether defendant received full credit for time spent in custody after she was sentenced to 365 days in jail and lifetime probation in two circuit court files, and 273 days in jail and lifetime probation in another file. In all other respects the delayed application for leave to appeal is denied. Jurisdiction is not retained. Court of Appeals No. 245434.
