On order of the Court, the delayed application for leave to appeal from the February 5, 1999 decision of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.

Cavanagh and Kelly, JJ., would remand this case to the Wayne County Circuit Court as successor to Recorder’s Court for the City of Detroit for the purpose of defendant’s filing a motion for new trial and the court’s conducting an evidentiary hearing on the matters raised in that motion.
