With regard to the people’s application No. 109564, I would grant leave to appeal to consider whether the decision of the Court of Appeals should be vacated, and the trial court’s sentence reinstated. The jury’s determination of second-degree murder and an enumerated felony indicates the factual equivalent of a finding of felony murder.
