On order of the Court, the application for leave to appeal the September 4, 2003 order of the Court of Appeals is considered and, pursuant to MCR 7.302(G)(1), in lieu of granting leave to appeal, we VACATE the order of the Court of Appeals and the April 2, 2003 order of the Wayne Circuit Court denying defendant’s motion for relief from judgment, and we REMAND this case to the Wayne Circuit Court for entry of an order resolving defendant’s motion for relief from judgment that is consistent with MCR 6.508(E).
We do not retain jurisdiction.
