By order of June 30, 1999, the application for leave to appeal was held in abeyance pending the decision in Nawrocki v Macomb Co Rd Comm (Docket No. 107903) and Evens v Shiawassee Co Rd Comm (Docket No. 109921). On order of the Court, the decision having been issued on July 28, 2000, 463 Mich. 143 (2000), the application is again considered, and pursuant to

MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for reconsideration in light of Evens supra.
