By order of April 9, 2002, the application for leave to appeal from the July 17, 2001 decision of the Court of Appeals was held in abeyance pending the decision of the special panel in Weaver v. City of Detroit
(Court of Appeals Docket No. 218514). On order of the Court, the decision having been issued on July 16, 2002, 252 Mich. App. 239 (2002), the application is again considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the judgment of the Court of Appeals and REMAND the case to that court for reconsideration in light of the special panel decision in Weaver, supra.

We do not retain jurisdiction.

Kelly, J., would grant leave to appeal.
