By order of October 30, 2000, the application for leave to appeal was held in abeyance pending the decision in Lugo v Ameritech (Docket No. 112575) and Woodbury v Bruckner (Docket No. 113709). On order of the Court, the decision in Lugo v Ameritech having been issued on July 3, 2001, 464 Mich. 512 (2001) and the order in Woodbury v Bruckner having entered on July 5, 2001, 464 Mich. 875 (2001), the application is again considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REMAND this case to the Wayne Circuit Court for reconsideration in light of Lugo v Ameritech.

Kelly, J., would deny leave to appeal.
