586 N.W.2d 232
No. 109590.Supreme Court of Michigan.
Decided June 16, 1998
Summary Dispositions June 16, 1998:
In lieu of granting leave to appeal, the matter is remanded to the Saginaw Circuit Court for further consideration. MCR 7.302(F)(1). The judge assigned to Docket No. 72-20156-4 is to review the Parole Board’s intent to hold a public hearing on the petitioner’s parole, examine the information with regard to the offense and offender, and decide whether to file a written objection within thirty days of this order. See MCL 791.234(6)(b); MSA 28.2304(6)(b). The judge who objected to parole on October 28, 1993, had been disqualified from the case as of October 17, 1991, and thus was no longer the successor judge. On remand, the successor judge is to make written findings and conclusions in this regard and is to file them with the Clerk of the Supreme Court. Jurisdiction is retained.
